The School and the Mount Vernon Woods Community Association enter into an Agreement in which the School agreed to certain development and use conditions and the Association agreed to support the School’s Special Use Permit request.
The Agreement became effective on the date of execution and remains “in full force and effect through midnight of the date immediately preceding the 20th anniversary of the date of issue of the initial building permit for the property” at 510 Mt. Vernon Highway, NE.
Fulton County issued building permits in 2005, so the agreement will expire in 2025.

The declaration of covenants, conditions, and restrictions that the School entered into at the time of purchase for the 30-acre property, is recorded.
This declaration terminates automatically after a period of 20 years after the declaration is recorded. Scenarios also exist that could terminate the declaration earlier.
This declaration will expire, at the latest, in February 2025.

City of Sandy Springs approves a rezoning request by Ashton Woods for approximately 36 acres adjoining the School that was later developed for the Aria West Community. A condition of this rezoning required that “a minimum of ten (10) acres shall be dedicated to recreational fields.”

The School purchases the 10 acres earmarked for recreational fields. At the time of purchase, the School enters a declaration of restrictive covenants covering the 10-acre parcel. This declaration requires the 10-acre property to be used “only for recreational and athletic fields and appurtenant facilities” and restricts lighting on the fields. The Declaration is drafted to remain in effect “perpetually to the extent provided by law…”

The Sandy Springs City Council approves a Special Use Permit and concurrent variances for the School to update the School’s long range facility plan (performing arts facility, parking lot, gymnasium, support buildings). Condition #3.d. limits the School from lighting its outdoor recreational fields.
